You shouldn't doubt yourself so...

Since you probably couldn't get approval from Take-Two {otherwise AC and CJ would be working on another game right now}, you might consider renaming it, but I think you could get a helluva Comic Strip going...
You cut the pics and have some one crop out a storyline for it... Make a few different weeks'/month's worth and present them to the Washington Post or Reader's Digest or Playboy, something that is highly spread... Jen seems to have a decent talent for writing, granted it would have to have a different approach than an Actual Tex Story, due to the Copyright laws, but only certainly things need to change... Location, make it New York instead of California... Names, The name can be changed to virtually anything... Other than that, how different can you really make a Private Eye storyline??? You can't that's the point, so they can't really say anything for the stories sounding similar...

Well my stuff isn't up to publisher standards (plus i think having an editor would suck) but i did attempt a private eye comic once. A friend of mine wrote it. We did one case.

That is fine quality for a News Paper or Magazine like Reader's Digest or Playboy... Add a few touches of color and you're good to go...
Normally when you work freelance, the editors will look it over briefly to make sure it isn't going to be offensive, but otherwise will pretty much leave your work alone... The only changes they'll make will be to make sure it fits in the a lotted space for your work...
I don't know what kind of time pressure your under, but if you could work up another couple of stories for it along with the pics to go along with it of course, I think you'd have a shot at making a few bucks... Matt Groening didn't start out at the top, but is sure there now...

Just a personal observation, I would try to come up with a catcher name than Smithy... It would be great if you could get the Approval to use Tex Murphy, but I think that is just wishful thinking...
I see a lot of talent behind that work of yours and I really think you could do something with it...
